在著作权法中，版权的保护方式就是赋予版权人控制作品传播方式的专有权。在网络环境下，当作品通过网络向公众传播时，法律应当赋予著作权人一种直接的控制作品在网络上传播的权利。这就是网络传播权。我国著作权法给网络传播权的定义是：“以有线或者元线方式向公众提供作品，使公众可以在其个人选定的时间和地点获取作品的权利。”
2001年修改的《著作权法》在第十条第（十二）项对信息网络传播权作了明确规定，同时，新《著作权法》还将该种权利延及到表演者、录音录像制作者。这些规定依据网络环境下著权保护的需要，采纳了“信息网络传播权”这样的全新的法律术语，与《世界知识产权组织版条约》（WCT）和《世界知识产权组织表演和唱片条约》（WPPT）以及多数国家的相应规定基本一致，完全符合网络环境下保护著作权的立法要求
